have an incredible amount of discretion in the American justice system.
In the case of minors engaging in consensual sexting, a prosecutor
could use their discretion to charge the individuals with a lesser
crime. In this example, it is an issue of felony child exploitation and
child pornography, both very serious crimes, but that does not mean that
a teenager’s life should be ruined because of poor decisions. The
prosecutor could lower the charges, as to not ruin the lives of teens
that had engaged in a consensual activity. In this case, the
girlfriend’s chargers were lowered to a misdemeanor. It is beyond the
prosecutor’s ability to enact new laws regarding sexting between minors
but they have the ability to decide what to charge, as in this case with
a misdemeanor, and also suggest what sentencing to give the offender is
convicted, hopefully attempting to lower the punishment.

Standards for Criminal Justice: Prosecution Function and Defense Function simply states,
“The duty of the prosecutor is to seek justice, not merely to convict.”
To elaborate, Berger v. United States (1935) states that the role of
the prosecution is to operate with “ethical” safeguards to limit the
chance of a wrongful conviction, Berger states that it is simply
wrong/unethical to convict an innocent person of a crime. Another
statement Berger emphasized on is the fact that the prosecutor
represents the Government, rather than an individual; therefore, if the
prosecutor is operating “outside of the rule of law” the respect for the
Government and the court system’s authority will diminish; it is
critical to our criminal justice system. As stated in the text “in
representing the state, the prosecutor has a large effect on how
citizens view their government” (Hemmens, pg 181). All in all, justice
will be done, not just to “win a case”.
