In all that I have read on jus and unjust conflict, I have come to the conclusion that every war, conflict, event has its own intricacies and to group all of these into one to punish equally would be ridiculous. To group in ISIS “soldiers” with our own troops is laughable. Although the wars the US wage may not meet all requirements for just war theory, classical or neo-classical, that does not mean that our soldiers should be susceptible to punishment just because they took part, in my experience there wasn’t a choice (other than to be conscientious objector) and it was not only a call to duty but your job, that you volunteered for. I believe that the officers and senior enlisted in charge should be capable of making good, on-the-ground decisions based on the information given to them at the time and if they make the wrong decision then they may be punished according to international law. The US abides by these war conventions (Geneva), ISIS is not a sovereign nation; without legitimate leadership and conducts acts of terror in order to further an agenda that is unclear and has no boundaries and follows no rules. I do not believe anyone in this organization should be treated with respect and in fact should be treated with as much regard and dignity as they treat others. In the fight against ISIS and the kind of hate they dispense, there should be no prisoners and no chance to spread the doctrine. When it comes to a sovereign nation, with legitimate leadership and a will to follow the international laws/treaties that have been born from modern conflict, these soldiers should only be punished under these laws.

No matter what, we can argue all day on if the Spanish Inquisition or the Crusades were legitimate but the fact is that we are talking about ethics only in the last 200 years or so. Before this there was no governing body to say, hey maybe there should be controls, maybe we should look at the wars we wage closely and decide if it’s a good idea.
